During the demolition process, the demolition of houses is often a part of the demolition activities. However, houses cannot be demolished casually. Legal procedures must be followed when demolishing houses. The following are the four prerequisites for house demolition. House demolition should be based on the needs of public interests. House demolition should be based on the needs of public interests.
According to the definition of Baidu Encyclopedia, public interest refers to things that can meet the needs of everyone within a certain range, that is, things with public utility, or resources and conditions with public utility that can meet the survival, enjoyment and development of everyone within a certain range. The law does not clearly clarify what is the need for public interest. For details, please refer to the "Regulations on the Expropriation and Compensation of Houses on State-owned Land".
1. The needs of public interest mainly refer to:
(1) National defense and diplomatic needs;
(2) The needs of energy, transportation, water conservancy and other infrastructure construction organized and implemented by the government;
(3) The needs of public utilities such as science and technology, education, culture, health, sports, environment and resource protection, disaster prevention and reduction, cultural relics protection, social welfare, and municipal utilities implemented by the government;
(4) The needs for the construction of affordable housing projects organized and implemented by the government;
(5) In accordance with the relevant provisions of the Urban and Rural Planning Law, the need for reconstruction of old urban areas in areas with concentrated dilapidated buildings and backward infrastructure organized and implemented by the government;
(6) Other public interests stipulated in laws and administrative regulations.
2. Legal compensation should be given to demolished houses
As mentioned before, house demolition is for the public interest, and it is mandatory. It will be difficult for the demolished people to stop the demolition process. However, the law also clearly stipulates that the demolished houses must be compensated. According to the law, the compensation methods mainly include monetary compensation and property rights exchange.
3. Monetary compensation refers to the market price of similar houses in the surrounding area, and the minimum standard for property rights exchange is not less than 1:1. 3. Follow the principle of “compensation first and relocation later”. According to regulations, after the demolisher and the demolished person have reached a demolition compensation and resettlement agreement or the demolisher who has made a compensation decision compensates the demolished person, the demolished person will complete the relocation within the relocation period determined in the demolition compensation agreement or compensation decision.
4. House demolition must strictly abide by legal procedures and authority. The "Land Management Law", "Regulations on the Expropriation of Houses on State-owned Land", "Regulations on the Implementation of the Land Management Law" and other laws and regulations stipulate the authority and procedures for house demolition. Demolitionists should strictly abide by legal authority and procedures. Otherwise, it is illegal and needs to bear corresponding legal liability.
What needs to be reminded here is that many times the demolition department carries out demolition in the name of "demolition violations", which is a typical illegal act of "replacing demolition with demolition violations". If you receive the above-mentioned legal documents issued by the government department, do not panic, start legal procedures in time, and stop the forced demolition. If you do not know how to operate, you should consult a professional land acquisition and demolition lawyer in time, and do not delay the opportunity to defend your rights.
