According to "Urban HousingDemolitionManagement Regulations" and relevant regulations of the Ministry of Housing and Urban-Rural Development:
1. The definition of commercial buildings shall be based on the ownership certificate on the property certificate.
2. However, as far as the current situation in our country is concerned, there are very few houses for commercial use on the house ownership certificate. In reality, there are a large number of private houses for commercial use. As long as you have obtained a legal business license, have a legal and complete tax payment certificate, and the business license registration location is the same as the actual business location, you can also be compensated as a commercial building.
3. Compensation for urban houses shall be based on the building area, purpose and location of the house. In addition to being compensated as normal urban houses, commercial houses should also be compensated for one-time suspension of production, suspension of business losses and decoration costs. There will be different regulations in various places for one-time suspension of production and business suspension losses. Decoration costs shall be negotiated between the demolisher and the person being demolished. If the negotiation fails, the assessment will be determined.
