Recently, the Hefei Municipal Government issued the 2017 "Notice on accelerating the pilot project of housing rental in Hefei City》. The "Notice" clarifies the basic rights and interests that housing tenants will enjoy in terms of compulsory education, basic medical care, family planning, public health, health promotion, basic pension, employment services, social security, community affairs, housing security and provident fund withdrawal. In order to conscientiously implement the spirit of the 19th National Congress of the Communist Party of China, adhere to the positioning that houses are for living in, not for speculation, and accelerate the establishment of a housing system with multi-subject supply, multi-channel guarantee, and both rental and purchase, so that all people can have a place to live, in accordance with the requirements of the "Hefei Municipal People's Government's Notice on Issuing the Implementation Plan for the Hefei Housing Leasing Pilot Work" (He Zheng Secretary [2017] No. 82), the notice on accelerating the housing rental pilot work in our city is as follows:
1. Cultivate market supply entities
1. Establish a state-owned housing rental company. With the state-owned investment companies at the city level, each district, and the three major development zones as the main body, state-owned housing leasing companies have been established to be responsible for the raising (new construction, reconstruction, revitalization, transfer, purchase, and leasing), operation and management of rental housing at the same level. Encourage state-owned housing rental companies to cooperate with social housing rental enterprises.
The municipal state-owned housing leasing company will be put into operation before the end of October 2017, and it will raise no less than 2,000 rental housing units by the end of the year; by 2020, it will raise a total of no less than 20,000 rental housing units. All state-owned housing rental companies in each district and the three major development zones will be put into operation before the end of November 2017, and no less than 500 rental housing units will be raised by the end of the year; by 2020, a cumulative total of no less than 20,000 rental housing units will be raised. 2. Cultivate and develop housing rental enterprises. Support and cultivate a group of housing rental enterprises with standardized services and good reputation, and encourage chain operations and cross-regional operations. 3. Develop diversified housing rental entities. Encourage real estate development companies to transform from traditional development and sales to a "both renting and selling" model, holding some of the houses in their own commercial housing projects for a long time and leasing them to the market. Encourage real estate development companies to cooperate with housing rental companies to establish an integrated and professional operation model for development and leasing. Encourage real estate brokerage agencies to provide housing rental custody, intermediary agency services and related professional services, and encourage property service companies to take advantage of management convenience and be entrusted by owners to expand housing rental business. For real estate brokerage agencies that provide intermediary services for more than 1,000 houses per year and property service companies that provide intermediary services for more than 100 houses per year, "green channels" will be opened in terms of housing verification, lease filing, tax processing, etc. (Responsible units: Municipal Real Estate Bureau, Municipal State Taxation Bureau, Municipal Local Taxation Bureau)
4. Support and regulate individual rental housing. Encourage individuals to entrust their own idle houses to housing leasing companies or rent them out through the government housing leasing transaction service supervision platform; encourage lessors to establish long-term and stable leasing relationships with lessees and housing leasing companies. 5. Develop modern housing rental service industry. Support traditional real estate development, brokerage, property services and housing leasing enterprises to expand the service areas and extend the service chain by developing "housekeeper-style" services to provide lessors and lessees with professional services such as house decoration, catering, housekeeping, home care, rent collection, management, and maintenance, and develop the modern leasing service industry. 2. Increase the supply of rental housing
6. Prepare a rental housing development plan. The Municipal Housing Leasing Leading Group Office will prepare a rental housing development plan in conjunction with the municipal planning, land, land reserve, development and reform, construction and other departments. By 2020, about 160,000 units of various types of centralized rental housing will be raised, of which about 40,000 units will be raised by state-owned housing leasing companies at the municipal and district levels, 10,000 units of talent apartments, 20,000 units of self-owned rental housing built by real estate development companies, and no less than 90,000 units of public rental housing in urban areas, forming a multi-level and multi-channel rental housing supply system. 7. Increase the supply of land for rental housing. The land supply for rental housing will be included in the annual land supply plan, and the annual land supply area for rental housing (including construction) will account for approximately 15% of the land supply area for newly built commercial housing. Explore new models of land supply and land bidding for rental housing to reduce rental housing construction costs. In 2017, the total area of land for rental housing shall be no less than 300 acres, and the planned construction of no less than 6,000 units of rental housing shall be no less than 300 acres. The following content should be clarified in the land supply plan: rental housing constructed on separately transferred land shall be held by the transferee as a whole and continued to be rented and operated during the transfer period; the rental housing constructed with the land may be self-owned by the development enterprise, or may be repurchased by a government-designated agency at cost price. Supplementary rental housing and commercial housing share the supporting facilities of the community, and no separate or restrictive boundary enclosures are allowed between the auxiliary rental housing and commercial housing. Newly built rental housing must be fully furnished and delivered, and may not be divided and transferred, or the use of land and housing may be changed, and a single lease term shall not exceed 15 years. If a real estate development enterprise converts commercial housing available for sale into rental housing, it may not go through the real estate registration procedures temporarily; if it has been rented out continuously for more than 10 years and the lease is terminated, it may go through the sales and real estate registration procedures as a new commercial house when selling, and pay relevant taxes and fees according to the tax policy at the time of sale. 8. Optimize the rental housing land supply process. District governments and the management committees of the three major development zones apply to the Municipal Land Reserve Center for land acquisition and storage projects. The Municipal Planning Bureau issues project land planning and design conditions. The Municipal Housing Leasing Leading Group Office issues a letter of recommendation on project land supply conditions. The Municipal Land and Resources Bureau prepares a land supply plan and submits it to the Municipal Land and Resources Committee for review and approval before it is put on the market for supply. If it involves the transfer, reconstruction, or purchase of existing houses, the Municipal Land and Resources Bureau will handle the real estate change registration procedures based on the relevant approval issued by the Municipal Government’s State-owned Assets Supervision and Administration Commission; if it is necessary to go through the land transfer procedures, it will make up for the land transfer procedures. 9. Strengthen the construction of talent apartments. Efforts should be made to solve the housing problem of newly introduced senior talents and above. By the end of 2017, 11 land supply projects will be completed, of which 7 projects including the High-tech Zone, Xinzhan District and Shushan District have started construction; by 2020, 10,000 talent apartments will be basically built in the city. 10. Allow qualified commercial buildings to be converted into rental housing. For completed, unsold, and unoperated commercial buildings with large inventory, convenient transportation, and complete public and living supporting facilities, on the premise of meeting the living conditions such as fire protection, safety, sanitation, lighting, ventilation, etc., the property rights unit shall propose a reconstruction plan and submit it to the Municipal Planning Bureau for review and solicit opinions from the Municipal Land and Resources Bureau before submitting it to the municipal government. With the approval of the municipal government, buildings can be used as basic units and converted into rental housing in accordance with regulations. The converted rental housing may not be sold. The reconstruction plan must first seek the opinions of the local government (development zone management committee) and obtain written consent from the interested parties.
During house renovation, the load-bearing structure and main structure of the house shall not be changed without authorization, and the building area of a single unit shall not be less than 22 square meters; after renovation, the land use, land use period and floor area ratio shall not be changed, and water, electricity and gas consumption shall be in accordance with residents' standards. 11. Revitalize the social housing stock. Encourage individuals and social institutions to put existing housing with clear property rights, complete functions, and qualified quality into the housing rental market, and encourage housing rental companies to raise housing resources through long-term leases, purchases, etc. Municipal and district state-owned housing leasing enterprises actively revitalize long-term unallocated resettlement housing, idle public housing and directly managed public housing. For state-owned houses rented out through public bidding, the single lease term shall not exceed 15 years. 12. Carry out pilot projects for building rental housing on collective construction land. Formulate the "Hefei City's Implementation Plan for the Pilot Project of Using Collective Construction Land to Build Rental Housing" and carry out the pilot project of using collective construction land to build rental housing. At the end of 2017, 1-2 projects will be selected to launch pilot projects; in 2019, they will be implemented in multiple locations across the city. 3. Establish a housing rental service and supervision system
13. Build a Hefei housing rental transaction service supervision platform. At the end of 2017, the housing rental transaction service supervision platform was launched online. All types of housing such as state-owned rental housing (including public rental housing), rental housing built on collective construction land, self-owned rental housing by development enterprises, intermediary agency housing, and individual rental housing will be included in the unified supervision of the platform; through measures such as housing information release, housing verification, and online signing and filing of lease contracts, the security of housing rental transactions will be strengthened and the whole-process supervision of housing rental transactions will be realized. Use the municipal big data platform and the "Internet +" government service platform to promote departmental information sharing and provide online one-stop services for housing rental companies, lessors, and lessees. 14. Establish a housing rental service management agency. Establish housing rental service management agencies at the municipal and district levels. Each development zone shall specify corresponding management agencies, and each township (street) shall specify corresponding agencies to assume their responsibilities and be equipped with fixed staff. The funds required for the supervision and management of house leasing shall be included in the financial budget of the same level. 15. Improve housing rental services. Promote housing rental contract model texts and online contract signing, implement the housing rental contract registration and filing system, optimize the filing process, and simplify filing procedures. Improve the rental price system for rental housing, establish a system for releasing information on housing rental levels, conduct surveys on housing rental levels in urban areas, and regularly release rental price information. 16. Strengthen housing rental credit management. Establish a housing rental industry association to improve professional standards, strengthen industry self-discipline, and standardize business practices. Relying on the municipal housing rental transaction service supervision platform, establish and improve the housing rental credit management system. Implement a credit commitment system, implement hierarchical and classified supervision of real estate development companies, house leasing companies, real estate brokerage agencies, and property service companies engaged in housing rental business, and provide credit bonus points to honest companies. Establish a "red list" and "black list" management system to record the trustworthy and untrustworthy behaviors of all parties to the lease in the credit files. Through the municipal public credit information sharing service platform, multi-department information sharing is realized, and a joint incentive mechanism for trustworthiness and a joint punishment mechanism for dishonesty is formed. 17. Standardize housing rental behavior. Establish a registration system for housing rental enterprises and improve the market access and exit mechanism. The lessor and the lessee should sign a written housing lease contract to clarify the rights and obligations of the parties. Lessors are encouraged to sign long-term housing lease contracts with lessees and housing leasing companies; for housing leasing companies that rent out their own houses, the lease period shall be no less than 3 years, unless otherwise required by the lessee.
During the contract period, the lessor shall not terminate the contract without justifiable reasons, shall not unilaterally increase the rent, shall not withhold the deposit at will, shall not modify non-residential houses for rent without authorization, and shall not use basements, balconies, attics, storage rooms, etc. for rent. The lessee shall use the housing and indoor facilities in accordance with the contract, pay rent on time, shall not demolish or modify the structure of the house without authorization, and the rented state-owned housing shall not be sublet. 4. Increase policy support
18. Provide tax benefits. For houses rented by enterprises, institutions, social groups and other organizations to individuals for residence at market prices, the property tax is levied at a reduced rate of 4%. For individuals who rent their own houses and the monthly rent is less than 30,000 yuan, a comprehensive rate of 4% (exemption from value-added tax) is applied; for those whose monthly rent is more than 30,000 yuan (including 30,000 yuan), a comprehensive rate of 8% is applied (including a reduced value-added tax of 1.5%).
Small-scale taxpayers who lease real estate to external parties can apply the simplified tax calculation method and calculate and pay VAT at a 5% levy rate; general taxpayers who acquire real estate before April 30, 2016 and rent it out may choose to apply the simplified tax calculation method and calculate and pay VAT at a 5% levy rate.
House leasing intermediary enterprises pay VAT based on agency fee income. General taxpayers calculate the output VAT tax at 6%, and small-scale taxpayers calculate and pay VAT at 3%. If a real estate development enterprise uses commercial housing developed by itself and has not obtained a property rights certificate for long-term leasing, if the property rights certificate is issued in the name of the enterprise itself, it will not be regarded as a sale and subject to value-added tax.
If the real estate is leased in the form of advance payment, the rental income obtained in advance can be evenly distributed during the lease period corresponding to the advance payment to calculate the monthly rental income. 19. Provide financial rewards and subsidies. In the next three years, the municipal finance will arrange certain funds and provide financial incentives and subsidies to outstanding enterprises that carry out housing rental business and individuals who rent out their own houses for a certain period of time (specific policies will be formulated separately). 20. Provide financial support. Strengthen bank-enterprise collaboration, encourage financial institutions to increase credit investment in housing rental companies, and support national policy banks and some commercial banks in providing long-term low-interest loans. Encourage financial institutions to carry out housing rental income rights pledge loan business and launch financial products that are consistent with the operating characteristics of housing leasing companies. Support qualified large-scale housing leasing companies and real estate development companies to expand financing channels by using financing tools such as bond issuance and real estate securitization. 5. Protect the rights and interests of housing tenants
21. Guarantee the right to receive compulsory education. For all school-age children and adolescents with household registration in Hefei City, whose parents or other legal guardians do not have housing in the city, they use a separately rented house as their only residence and register it for the record. The education department in the district where the rental place is located will make overall arrangements for enrollment; if they meet the "household same" condition, the education department in the district where the rental place is located will arrange for enrollment in the nearest school.
For school-age children and teenagers who are not registered in Hefei City, their parents or other legal guardians do not have housing in this city, and have obtained a residence permit in this city for one year. With a labor contract or business license, the education department in the district where the residence permit is located will make overall arrangements for enrollment; parents or other legal guardians If the guardian has rented the same complete house and registered it for three consecutive years, and has paid Hefei urban employee social insurance or statutory taxes and fees for three consecutive years, the education department in the district where the rental is located will arrange for enrollment in the nearest school, subject to the permission of regional education resources.

22. Enjoy basic public health services. Housing tenants who have lived in their place of residence for more than 6 months can enjoy the same basic health services as local residents at the health service agencies in the jurisdiction with the lease registration certificate. Pregnant women can apply for free maternal health care manuals at local community health service centers, and children can apply for free child health care manuals and vaccination certificates on site, and receive Class I vaccines for free. 23. Enjoy basic public elderly care services. Housing tenants over the age of 60 can enjoy the elderly care services provided by home elderly care service centers (stations), elderly day care centers, elderly activity centers, elderly schools and other community elderly care service facilities in the jurisdiction on the same basis as local residents by presenting a lease registration certificate. Housing tenants over the age of 70 can take buses, subways and other urban public transportation for free. 24. Participate in social insurance and enjoy employment and entrepreneurship services. Housing tenants who are employed and start a business in enterprises registered in Hefei City can participate in various social insurances in Hefei City and enjoy relevant benefits in accordance with regulations; they can equally enjoy various public employment and entrepreneurship services at all levels of public employment talent service agencies in Hefei City, such as participating in public welfare recruitment, personnel file agency, employment and entrepreneurship guidance, application for employment and unemployment registration certificates, and protection of labor security rights and interests, etc. (Responsible units: Municipal Human Resources and Social Security Bureau, Municipal Industry and Commerce Bureau)
25. Provide housing provident fund support. Housing tenants and spouses or single employees who have paid and deposited the housing provident fund in full for three consecutive months in our city, and who do not own property and rent a house in our city, can withdraw the housing provident fund to pay rent in accordance with relevant regulations. 26. Lower the threshold for household registration. Housing tenants can apply for a residence permit with a rental registration certificate. If the housing tenant has been legally and stably employed in the urban area for two consecutive years and has participated in urban social insurance for one year in accordance with national regulations, he and his spouse and minor children who live together can apply for collective household registration at the place of employment. 27. Promote the monetization of public rental housing. Adopt a combination of physical security and rental subsidies and gradually shift to a security method dominated by rental subsidies. Improve the rental subsidy system, and provide reasonable rental subsidies to qualified new citizens, such as imported talents, newly employed college students, and migrant workers with stable employment, based on market rent levels and the actual conditions of the insured objects, to support them in renting through the market, and to form a housing security system in which public rental housing and market rental housing complement each other. 28. Protect democratic political rights. Housing tenants who have lived in the community where they live for more than one year and have obtained a residence permit can participate in the election of the residents' committee of their community. 29. Apply for temporary assistance. Housing tenants who have obtained a residence permit in Hefei and meet the conditions for temporary assistance stipulated by the government of their place of residence can apply for temporary assistance from the government of their place of residence. 6. Job security measures
30. Strengthen organizational leadership. The municipal housing leasing pilot work leading group coordinates the city's housing leasing pilot work, holds special scheduling meetings regularly, studies and solves major problems in the work, and promotes the construction of housing leasing pilot projects in an orderly manner. The Municipal Housing Leasing Pilot Leading Group Office is responsible for the supervision, inspection and guidance of the pilot work, and promptly studies and solves problems existing in the pilot work. 31. Clarify job responsibilities. The municipal real estate administrative department is responsible for guiding and supervising the city's housing leasing work; the district housing and construction administrative department (including agencies designated by the development zone) is responsible for the specific supervision and management of housing leasing in the region. Township (town) governments and sub-district offices are responsible for coordinating and handling housing rental matters and disputes within their jurisdiction, and are entrusted by the district housing and construction administrative department to undertake housing rental registration and filing work; village (neighborhood) committees are responsible for the verification and inspection of rental housing sources, lessors, lessees, and rental transactions.
District governments and the management committees of the three major development zones should strengthen their leadership over housing rental work, bring housing rental management into the scope of comprehensive community management, shift the focus of housing rental management and services downwards, give full play to the role of grassroots organizations such as townships (streets) and village (neighborhood) committees, and implement grid management of housing rentals. 32. Strengthen departmental linkage. The member units of the Municipal Housing Leasing Pilot Leading Group shall, in accordance with their respective responsibilities, strengthen mutual assistance and collaboration, jointly carry out work related to the supervision and management of housing leasing, and coordinately promote the construction of housing leasing pilot projects. The municipal real estate, public security, land, planning, urban management, industry and commerce and other departments jointly supervise the housing rental behavior and strengthen the security management of rental housing. The municipal public security department has compared the management methods of the hotel industry and connected the information of non-local registered renters registered by development, brokerage, property services and housing rental companies to the temporary population management information system to obtain real-time information on tenants. The municipal judicial and arbitration departments should guide and assist communities in establishing a convenient mediation mechanism for housing rental disputes. All enterprises, institutions, social groups and other organizations should cooperate with relevant departments in the supervision and management of house leasing. 33. Strict assessment and evaluation. The housing rental pilot project will be included in the scope of the municipal government's inspection of key matters. For units that perform poorly and make slow progress, the Municipal Housing Leasing Pilot Leading Group Office will issue a notice of criticism during the year-end assessment. 34. Strengthen public opinion guidance. Increase the publicity and guidance of public opinion, make full use of television, radio, newspapers and other media and online platforms such as WeChat and Weibo, and adopt various forms such as lectures and distribution of brochures to vigorously publicize the importance of carrying out leasing pilot work, timely and accurate interpretation of relevant policies, guide citizens to gradually establish the concept of housing consumption of renting before buying, tiered consumption, and tiered improvement, and create a good public opinion atmosphere and social environment. This notice will be implemented on a trial basis from October 31, 2017, and will be valid for 2 years. The city’s housing leasing pilot work leading group office will be responsible for the explanation. All relevant departments can formulate specific operating methods based on this notice. For school-age children and teenagers who are not registered in Hefei City, their parents or other legal guardians do not have housing in this city, and have obtained a residence permit in this city for one year. With a labor contract or business license, the education department in the district where the residence permit is located will make overall arrangements for enrollment; parents or other legal guardians If the guardian has rented the same complete house and registered it for three consecutive years, and has paid Hefei urban employee social insurance or statutory taxes and fees for three consecutive years, the education department in the district where the rental is located will arrange for enrollment in the nearest school, subject to the permission of regional education resources.
2. Enjoy basic public health services.
Housing tenants who have lived in their place of residence for more than 6 months can enjoy the same basic health services as local residents at the health service agencies in the jurisdiction with the lease registration certificate. Pregnant women can apply for free maternal health care manuals at local community health service centers, and children can apply for free child health care manuals and vaccination certificates on site, and receive Class I vaccines for free.
3. Enjoy basic public elderly care services.
4. Participate in social insurance and enjoy employment and entrepreneurship services.
5. Provide housing provident fund support.
Housing tenants and spouses or single employees who have paid and deposited the housing provident fund in full for three consecutive months in our city, and who do not own property and rent a house in our city, can withdraw the housing provident fund to pay rent in accordance with relevant regulations.
6. Lower the household registration threshold.
Housing tenants can apply for a residence permit with a rental registration certificate. If the housing tenant has been legally and stably employed in the urban area for two consecutive years and has participated in urban social insurance for one year in accordance with national regulations, he and his spouse and minor children who live together can apply for collective household registration at the place of employment.
7. Promote the monetization of public rental housing.

9. Apply for temporary assistance.
