Future resettlement work must be done well before demolition, and demolition compensation is one of the resettlement tasks. So what are the compensation methods for relocation? How much compensation is generally reasonable for relocation? I believe many people who know that their houses are going to be demolished would like to know. Let’s take a look with the editor of Yingting Law Firm.

What are the compensation methods for relocation?
According to my country's current legal provisions, there are three forms of housing relocation compensation: monetary compensation, property rights replacement, and combined compensation.
1. Monetary compensation: means that the demolisher uses relevant statutory standards and entrusts a professionally qualified appraisal agency to conduct a professional and market-economy valuation of the houses to be demolished.

The amount of relocation compensation that the demolishers need to pay is determined based on the market price of other similar houses that is not lower than the date of announcement of the expropriated house, and based on the estimated price. (If there is any objection to the evaluation agency's house value assessment, the demolished person can conduct a review assessment. If there is also an objection to the review result, the demolished person can apply to the appraisal expert committee for re-appraisal)

(Note: For the market prices shown above, the local government departments will formulate a corresponding housing market price list based on the annual residential housing market price patterns and fluctuations in the area. The demolished people can use this for reference and calculation. If it is difficult to determine the price of demolished housing in your area, you should consult the relevant local government departments such as the construction department).

2. Property rights replacement: Also called replacement housing compensation, it can be divided into two replacement methods: standard property rights replacement and area standard property rights replacement based on different evaluation methods.
3. Combined compensation: It means that in the relocation compensation, the demolished houses are given both monetary compensation and property rights replacement compensation.
House relocation compensation types:

Depending on whether the houses to be demolished are in urban or rural areas, the types of relocation compensation can be divided into two types: compensation for house demolition on state-owned land and compensation for house demolition on collective land.
House relocation compensation projects: According to relevant provisions of the law, the following five compensation projects are supported:
1. Compensation for losses caused by suspension of production and business due to house expropriation;.

2. Compensation for relocation and temporary resettlement caused by house expropriation;
3. Compensation for the expropriated house value
4. Subsidies and incentives;
5. Compensation for house decoration and relocation of household appliances;
How much compensation is generally reasonable for relocation?
House demolition resettlement fee = relocation subsidy (cost of relocation) temporary resettlement subsidy after demolition
Additional temporary resettlement subsidy
Compensation for losses caused by suspension of production or business of non-residential buildings (such as commercial buildings).

Note 1: The subjects applying for house demolition and resettlement fees are: the demolished person and the lessee.
Note 2: If the demolition house is provided with turnover housing after demolition, there is no need to calculate the post-demolition temporary resettlement subsidy.
Note 3: The additional temporary resettlement subsidy is only applicable when the transition period is exceeded. If it is not exceeded, there is no need to calculate the demolition compensation standard for houses located in rural areas.

According to regulations, the compensation method for rural cultivated land occupation is to calculate the average annual output based on the total output of the previous three years when the cultivated land is expropriated, and then compensate 4-6 times the average output value (specific data is calculated according to local standards). Compensation for homesteads includes compensation for houses, attachments, trees, and other buildings in the courtyard.

Generally speaking, based on population, the relocation compensation available to each person is between tens of thousands to hundreds of thousands. The specific data depends on local implementation policies and per capita income levels.
Situation 1: The demolished people whose land is expropriated and do not have the conditions to build houses in relocation have two options: monetary compensation and property rights house exchange. If they choose the property rights house exchange compensation method, the value of their houses will be equivalent to the monetary compensation that should be compensated.

Situation 2: The land-expropriated person has the conditions to build a house in a different location. Demolished persons can apply for new housing (within the land permitted by law, such as central villages or residential areas planned by the local government) with relevant departments, and can also receive corresponding monetary compensation.
