Fifteen years ago (1999), a (Taiwanese) company bought a piece of land in Shunyi District to build a senior care center. Later, the land was planned as a green space. The company then took the Shunyi District Government to court and requested the district government to take back the land it purchased.

Enterprise: Planning green space leads to idle land

According to the agent of the plaintiff Beijing Hongbao Fangda Industry and Trade Co., Ltd. (referred to as Hongbao Company), from 1999 to 2000, the company contacted the then Shunyi District Planning Committee to negotiate the transfer of the land involved in the case. Later, under the arrangement of the Shunyi District Planning Committee, it signed a land transfer agreement with its subsidiary Beijing Shunyi District Fuluda Taxi Company and obtained a piece of land in Shunyi District.

"Originally we wanted to build a construction project for an elderly activity center," the plaintiff's attorney said. After taking the land, it was planned as green space. The Shunyi Branch of the Beijing Municipal Planning Commission clearly informed Hongbao Company that it could only approve the renovation of the original construction project, but not the new construction project. As a result, the land was idle and caused economic losses to the company.

On October 27, 2014, Hongbao Company applied to the Shunyi District Government for the resumption of state-owned land use rights and housing expropriation. The district government transferred the matter to the Shunyi Branch of the Beijing Municipal Bureau of Land and Resources for processing. The latter believed that Hongbao Company’s application did not meet the conditions and did not handle it.
