A medium-sized coal mining enterprise in a certain province has a mining license valid until June 30, 2024. Due to negligence in internal management, the company did not submit a renewal application to the registration management authority until mid-July. The staff refused to accept the application on the grounds that "the application was not submitted within the prescribed time limit", and the company was forced into the dilemma of unlicensed mining for several months, resulting in huge operating losses. This case is not an isolated one. In practice, it is not uncommon for mining rights to be lost due to improper timing of renewal applications. This article systematically sorts out the core rules for mining license renewal from a legal perspective and provides practical guidance for mining business owners.
According to the provisions of Article 24 of the "Mineral Resources Law of the People's Republic of China", the mining right holder shall go to the registration management authority to complete the renewal registration procedures 30 days before the expiration of the mining license. This is a rigid requirement of the law on the time limit for mining rights renewal applications. Late applications will face legal consequences of not being accepted. The newly revised "Mineral Resources Law" in 2024 further clarifies the validity rules of mining rights registration. Article 22, Paragraph 3 of the Law stipulates that the establishment, change, transfer, mortgage and elimination of mining rights shall be effective after being registered in accordance with the law; without registration, they will not be effective. This means that if the renewal registration is not completed after the mining license expires, the legal effect of the mining right will be extinguished, and companies that continue to mine will lose the basis of their rights.
Article 7 of the "Measures for the Administration of Registration of Mineral Resources Exploitation" (State Council Order No. 241) stipulates the conditions for renewal application in detail. Combining the Ministry of Natural Resources’ Natural Resources Regulations [2023] No. 4 Notice and the current mining rights change (renewal) registration service guide, the mining rights renewal must meet the following core conditions: First, the application materials must be complete and comply with the legal form, including the mining rights registration application form, real estate The right certificate (mining right) or original mining license, mineral resource reserve review and filing documents, proof of payment of income from the transfer of mining rights, etc.; secondly, there are still mineral resources available for exploitation in the registered mining area; thirdly, the mining rights involving paid disposal have been completed in accordance with regulations. According to the relevant provisions of the "Measures for the Collection of Proceeds from the Transfer of Mining Rights" (Caizong [2023] No. 10), if the transfer proceeds are not paid in full, it will also constitute a legal reason for denial of registration.
In judicial practice, there are many administrative lawsuits and criminal risk cases triggered by the renewal of mining licenses. In an administrative litigation case heard by the Higher People's Court of a certain province, the mining rights holder continued mining after the license expired because the approval process had not been completed. The natural resources authorities characterized it as illegal mining and imposed administrative penalties. After trial, the court held that the mining right holder submitted an application for renewal within the legal period, and the mining behavior during the approval period did not have the subjective intention of illegal mining, and revoked the relevant administrative penalty decision. This judgment clarifies the essential difference between "actively applying for renewal" and "mining without a license" and has important reference value for similar cases. However, it should be noted that the prerequisite for protection in this judgment is that the applicant files an application within the statutory time limit - if even this basic prerequisite is not met, there is no way to claim the above protection.
Based on the above legal analysis and judicial practice, mining companies should pay special attention to the following three points when renewing mining licenses:
One,Start renewal preparations three months in advance. The renewal of a mining license involves many aspects, including the preparation of annual reserves reports, verification of transfer income, and materials collection and declaration, and the cycle is relatively long. It is recommended that enterprises start preparations at least three months before the license expires to ensure that they have the conditions to submit a complete application 30 days before the expiration.
Secondly,Focus on verifying two key materials. The first is the status of mineral resource reserves, confirming that there are still mineral resources available for exploitation in the mining area; the second is the status of payment of proceeds from the transfer of mining rights, ensuring that the amount payable has been paid in full or is well documented. These two problems are the most common, and once defects exist, they will directly lead to blocked renewal.
Third,Keep application records properly. When submitting a renewal application, be sure to keep complete submission documents, including acceptance receipt, material list receipt record, etc. If it is unable to submit on time due to force majeure or reasons not caused by the enterprise itself, the enterprise shall promptly submit relevant supporting materials explaining the reasons to the registration authority for the purpose of providing evidence in subsequent disputes.
The renewal of mining rights is by no means a simple administrative procedure. It involves multi-dimensional compliance requirements such as reserves management, paid disposal, and green mine construction. Mining companies should establish an early warning mechanism for the expiry of mining licenses and incorporate renewal management into the core module of the corporate compliance system to avoid major economic losses and even legal risks due to procedural oversights.
