In early May 2025, the company submitted an application for the extension of mining rights to the natural resources authorities 30 days in advance in accordance with legal requirements, and attached all the materials. However, one or two months have passed since the approval deadline, and the competent authorities have still not made a written decision to approve or not extend the application. Enterprises are in a dilemma: if they continue to mine, they may face legal risks of illegal mining; if they stop mining, they will suffer huge economic losses every day. This dilemma of "the application is submitted but the reply is not forthcoming" is by no means an isolated case in mining practice. So, if the administrative agency fails to respond within the time limit, can the company's renewal application be regarded as approved? This issue is directly related to the protection of the legitimate rights and interests of mining companies and urgently needs to be clarified from a legal perspective. n[Analysis of laws and regulations]nnThe answer to the above question is stipulated in Article 50 of the Administrative Licensing Law of the People's Republic of China. This clause contains two core contents: nnFirst, regarding the application deadline. According to the first paragraph of Article 50 of the Law, if the licensee needs to extend the validity period of the administrative license obtained in accordance with the law, he shall submit an application to the administrative agency that made the administrative licensing decision thirty days before the expiration of the administrative license. Mining companies must strictly abide by this time requirement when applying for the extension of mining rights. Late application may result in the license being revoked. nnSecond, regarding the legal consequences of failure to respond within the time limit. Paragraph 2 of Article 50 of the Law clearly stipulates: "The administrative agency shall, based on the licensee's application, make a decision on whether to approve the extension before the expiration of the validity period of the administrative license; if no decision is made within the time limit, the extension shall be deemed to have been approved. "This provision is called "implied approval" in administrative law theory, that is, the silence of the administrative agency produces the legal effect of presumed consent after the expiration of the statutory period. nn It should be noted that the scope of application of the "implied approval" rule is clearly limited. According to relevant interpretations, this ruleApplicable only to extension applications for administrative licenses, does not apply to initial applications for administrative licenses and changes to administrative licenses. This means that mining companies must not invoke this rule to claim permission when applying for new mining rights. nnIn addition, if laws, regulations or rules otherwise stipulate the time limit for extension applications, such provisions shall be followed. For example, the "Measures for the Registration and Management of Mineral Resources Exploration Blocks" stipulates the application period for the extension of exploration rights. Mining companies must comply with the relevant provisions of both special laws and general laws. n[Relevant case analysis]nnIn the administrative reconsideration case between Guangdong New Supply and Marketing XX Logistics Co., Ltd. and the Guangzhou Municipal Planning and Natural Resources Bureau (Suifu Xingfu [2020] No. 322), the applicant claimed that the extension was deemed to be approved based on Article 50, Paragraph 2 of the Administrative Licensing Law, because the application for renewal of land use rights was not responded to in time. This case has important reference value for understanding the "implied approval" rule. The facts of the nn case show that the applicant submitted an application for land use right renewal to the respondent in July 2019, and the respondent did not issue a reply not to renew until March 2020. The applicant believes that the decision made by the administrative agency after the expiration of the validity period complies with the legal situation of "no decision made within the time limit" and should be deemed to be extended. nn However, after review, the reconsideration authority believed that the respondent actively reviewed and solicited opinions from relevant departments before submitting the application for approval by the Management Committee, and finally made the decision not to renew. The core dispute in the case is: whether the renewal of land use rights falls within the scope of "administrative license extension" adjusted in Article 50 of the Administrative Licensing Law. The reconsideration authority finally supported the respondent’s reply. nnThe guiding significance of this case is that the application of the "implied approval" rule is not unlimited. If the administrative agency is actively performing its review duties and making substantive decisions within the statutory period, it is not appropriate to simply apply the implicit approval rule. At the same time, there is still controversy over whether the relevant provisions of the Administrative Licensing Law are applicable to the renewal of different types of property rights, and it needs to be judged based on the nature of the specific legal relationship. n[Lawyer’s point of view]nnBased on the above legal analysis and case study, lawyer Liu Jingzhu of Beijing Yingtong Law Firm believes: nnThe "implied approval" rule established in Article 50 of the "Administrative Licensing Law" is an important legal system to protect the legitimate rights and interests of the licensee. In an application for extension of administrative licenses such as mining rights, if the administrative agency neither makes a decision to approve the extension nor makes a decision not to extend it within the legal period, the licensee may claim that the license has been extended in accordance with the law. nnHowever, mining companies need to pay attention to the following cognitive misunderstandings in practice: first, the "implied approval" rule cannot be extended to new license applications; second, if the administrative agency has initiated the substantive review process and expressed its intention not to extend, there are obstacles to the application of the implicit approval rule; third, there may be differences in the legal nature of the renewal of land use rights and the extension of mining rights, and they need to be judged separately. nn Regarding the practical operation of mining rights renewal, the following suggestions are made: nn First, be sure to submit an extension application thirty days before the expiration of the license, and keep complete submission certificates to avoid defects in the validity of the license due to late applications. nnSecond, after the application is submitted, you should continue to track the progress of the approval and communicate with the competent authorities regularly.
